HANOVER TOWNSHIP, LEHIGH COUNTY
PLANNING COMMISSION MEETING

June 16, 2009
7:30 P.M.

Approval of Minutes: - April 21, 2009 Planning Commission Meeting

Motion: --- I move we waive the reading of the Minutes of the April 21, 2009 Planning Commission Meeting and accept same as presented.

1. I move we waive the reading of the Minutes of the April 21, 2009 Planning Commission Meeting and accept same as presented (Review and Recommendation)

In attendance at the meeting, were various representatives of the Developer. Kevin Fruck of Cornerstone Engineering appeared before the Board at this time and reviewed with the Planning Commission a drawing relative to the proposed Sonic Restaurant. Mr. Fruck noted that the proposed Sonic Restaurant offers drive-in service whereby customers remain in their automobile and order off of a menu in the parking area and are served by roller service waitresses. In addition, there is no indoor seating, but there is a seasonal outdoor patio service. Mr. Fruck noted that adjoining the Sonic tract to the south is a Firestone facility which is presently under construction. There is a common access road between Airport Rd. and Lloyd St.; the access road will be shared by Firestone and Sonic customers. The common access road will provide right in right out turning only from Airport Rd. Access from Lloyd Street will provide full access. Access to the Sonic property will be off the common access road. A 10 foot drive thru lane circulating to the pickup window will be provided. Next to the drive thru lane, there will be a 20 foot access lane to the west of the facility and an 18 foot access lane to the east of the facility to permit the free flow of traffic through the property. The Sonic drive thru lane will have a queue of approximately 7.3 cars which is typical and customary for drive thru facilities. Mr. Fruck noted that there is more than sufficient parking proposed for this facility. It was further noted that the proposed restaurant will be 1,728 square feet.

At this point in the meeting, the Planning Commission reviewed the Township Engineer’s comment letter dated June 15, 2009 as same relates to his review of this proposed land development. The Developer acknowledged that they would have no problem with meeting the requirements set forth in the Township Engineer’s comment letter.

The Township Engineer advised the Planning Commission that the issues raised in his comment letter are drafting not design problems. In that regard, the Township Engineer advised the Board that he would recommend a preliminary final plan approval recommendation to Council. The Township Engineer further noted that there are no stormwater issues. He indicated that originally he had a concern over the queuing but they have worked that out. Mr. Hay also indicated that there are fire lanes on two sides of the building.

In resolution of this matter and based on the recommendation of the Township Engineer, the Hanover Township Planning Commission made the following motion.

Motion: --- I move that the Hanover Township Planning Commission recommends to the Hanover Township Council preliminary/final plan approval of the land development of Sonic Restaurant, Centres, Inc., 1753 Airport Rd., Allentown, PA 18109 subject to the following conditions:

1.) Each condition must be rejected or accepted in writing by the applicant within thirty (30) days of the date of this approval, or in the absence of such acceptance, this approval shall be deemed rescinded as of the expiration of the thirty (30) day period or the date of receipt of the rejection of any such condition, whichever first occurs.

2.) List the pipe and stormwater structure schedule on the utility plan.

3.) The roadway inlets shall have weep holes.

4.) Pipe bedding shall be 2A aggregate.

5.) The numerical classification for the structures shall be the same on the plan, profile and schedules.

6.) A profile for pipe run P9 shall be provided. Show 1-11 and 1-12 on the pipe schedule

7.) There are numerous grade conflicts between the plan and profiles.

8.) Show the yard drain and connection detail.

9.) A monitoring manhole shall be shown on the downstream end of the grease trap. Provide detail.

10.) The sanitary lateral pipe shall be SDR-26 – 6” to building transition.

11.) A detail of the lateral saddle shall be shown (Seal-Tite Type E)

12.) The curb shall be 22” depth, 7” reveal (Revise top of curb elevations on the profiles to reflect this change)

13.) Sidewalk concrete shall be 3500 psi.

14.) A note shall be placed on the record plan referring to the special exception use determination.

15.) The lot boundary does not close.

16.) A note shall be added to the plan concerning perpetual stormwater facilities maintenance.

17.) LCCD approval is required. LVPC review is required.

18.) The water-sewer crossing shall be eliminated.

19.) A dumpster enclosure detail shall be provided on the plans.

20.) Water connection and meter detail shall be shown on the plans.

21.) All fees shall be paid to the Township and Developer shall execute land development improvement, maintenance and security agreements to secure the construction and maintenance of required improvements in a form satisfactory to the Township Attorney.
