15, 2004, Regular Council Meeting and accept same as

Reports:
1.
Sandra A. Pudliner
Township Manager
1. The
Township Manager advised the Board that she would like to
file the necessary paperwork with respect to attendance at
the PSATS
Convention in Hershey. Chairman Paulus noted that he had
not had an opportunity to review the convention information
with
Councilman Dreisbach, the newest member of the Board. However,
Councilman Atkinson, Kovacs and Chairman Paulus indicated
that they will be attending. Information would be provided
to Councilman
Dreisbach with respect to the convention and the matter would
be discussed at the Board’s next Regular Council Meeting.
2. The
Township Manager advised the Board that she has provided
them with a copy of correspondence from a resident of the
Township in the Sherwood Street area with respect to his
issues with increased noise by the U. S. Foodservice facility
located in the Township. The Township Engineer noted that
he has spoken with the resident and explained to him that
a noise study had been conducted and that U. S. Foodservice
was required to abide by the Allentown noise limits and in
accordance with the results of the Township’s study,
they are within those limits. The resident had questioned
the Township Engineer as to when the study was done and the
hours of the study. The Township Engineer noted that he seemed
satisfied with the time frame of the study but indicated
to him that he felt he was going to move since the situation
was unacceptable to him. Chairman Paulus commented that he
wondered if they are moving more trucks onto the residential
side of their property. There was a discussion about monitoring
the truck traffic. The Township Manager was also directed
to forward a copy of the resident’s letter to U. S.
Foodservice.

Frederick W. Hay, P.E.
Township Engineer
1.) The
Township Engineer advised the Board that the wetland delineation
study for the Canal Park Project will be commenced tomorrow.
Councilman
Atkinson questioned the Township Engineer as to whether or
not if the study reveals there are wetlands would it still
be possible to wait until drier weather (summer) to check
it again. The Township Engineer felt that would not be acceptable.

J. Jackson Eaton, III, Esquire
Attorney's Report
1.) With
respect to the Lehigh Northampton Airport Authority Tax Appeal
matter, Council should be advised that the State Municipal
Authority’s Association has asked to file a brief in
support of LNAA. Attorney Eaton noted that he anticipated
the court would allow them to file such a brief and that
he would
keep Council advised of the further status of this matter.
2.) As
Council may recall, following the rezoning of the Witko tract
it was discovered that there was a tiny portion the developer
had incorrectly described in the documents. Council will
recall that the plan showed all of the area designated Medium
Residential was changed to Planned Commercial. The Township
Manager has recently asked me what the status was of this
matter and Council will be receiving an ordinance within
the next month to make that change. This will not require
going all the way back through the zoning process.

Atkinson questioned whether or not the work had commenced
on the storage building located in Canal Park. The
Township Manager advised that the siding replacement
and window
replacement work would commence shortly.
