I move we waive the reading of the Minutes
of the December 21, 2005 Regular Council Meeting and accept
same as presented.

Township Manager
There
was a discussion with respect to the Township’s intent to
purchase a squad truck from Emergency Vehicles, Inc.
The Township Manager advised that a meeting was held with the Fire
Chief,
a representative from Emergency Vehicles, Inc. and
the Township Manager for the signing of the initial contract and
a determination
regarding the payment schedule. The Township Manager
noted
that the Township Solicitor was contacted via telephone
at that time. The end result of the discussions was that the Township
determined not to upfront the majority of the funds
at this
time but rather pay for the chassis when it comes in
and the balance would be paid upon receipt of the vehicle. It was
noted
that Emergency Vehicles, Inc. could not provide the
Township with a drop dead date in terms of delivery of the truck
and also that the Township had determined that investing the funds
versus the savings for prepayment would virtually result
in
the same approximate savings to the Township. The Township
Clerk noted that she has placed the monies for the
squad
truck in Invest in a separate account and will hold the funds there
until needed.

W. Hay, P.E.
Township Engineer
The
Township Engineer advised the Board that the Township has a grease
problem at Pump Station No. 1 and that the Public Works Department
has placed chemical additives in the manholes. Mr. Hay noted
that the Bennigan’s Restaurant located in Hanover Township,
Northampton County, is not maintaining their grease trap and
that he had written a letter to the Township Manager with a carbon
copy to Hanover Township, Northampton County, and Liberty Property
Trust, putting them on notice of this problem. The Township Engineer
noted that Hanover Township, Northampton County, is indicating
that they have not as of yet accepted the sewer lines from Liberty
Property Trust for the development in that area. Councilman Atkinson
questioned the Township Engineer as to who the Township would
have legal recourse against as a result of this problem. Mr.
Atkinson noted that Hanover Township, Northampton County, appears
to have indicated that they did not accept the lines. The Township
Attorney felt that that does not matter and that the Township
does have legal recourse against Hanover Township, Northampton
County. The Township Attorney further noted that he would like
to look at the file on this matter. Councilman Atkinson noted
that the Township should determine the Township’s costs
for the chemicals the Public Works Department placed in the system
to help alleviate the grease buildup, as well as the time of
the Township’s personnel devoted to this problem. The Township
Attorney indicated he would look at the agreement between Hanover
Township, Lehigh County, and Hanover Township, Northampton County,
and what the ordinance says and determine the Township’s
authority.

Jackson Eaton, III, Esquire
Attorney's Report
The
Township Attorney advised that he has provided Council with correspondence
regarding the recent U. S. Supreme Court decision involving the
Airport Authority. Attorney Eaton requested an Executive Session
after the meeting to review the matter in detail.
Councilman
Atkinson acknowledged receipt of the Code Enforcement
Officer’s Report of Ray Seiling for the month
of December. It was noted that this report was missing
from the prior meeting and that he had reviewed same
and noted that the Code Enforcement Officer had chased
four Penn State students out of the intersection of
Airport and Catasauqua Roads. Apparently, they were
collecting money for MS. A discussion ensued and it
was determined that the Township had a legal right
to ask them to leave for safety purposes. It was further
noted that they did not have a solicitation permit.
Councilman
Kovacs questioned whether or not the Township has recovered
the missing fire lane sign that was noted in the Code
Enforcement Officers’ Reports and the Township
Manager advised that she did not know what had transpired
in that regard.
Councilman
Kovacs advised the Board that he felt that this would be a
good time to authorize the attendance of various individuals
at the PSATS Convention in Hershey in April of 2006. Accordingly,
the following Motion was made:

I move that we authorize attendance at the PSATS
Convention in Hershey, Pennsylvania, on April 23 through
April 26, 2006 for the following individuals: Bruce Paulus,
Randall Atkinson, Frank Dreisbach, Sandra Pudliner, Bruce
Pudliner, Frederick Hay, and William Kovacs.

Paulus acknowledged that the Board would be going into
Executive Session, but would not be coming back with any
decision.
