Township Meeting - Minutes

HANOVER TOWNSHIP, LEHIGH COUNTY
REGULAR COUNCIL MEETING

June 6, 2007
7:30 P.M.

Present: ---- Councilwoman Hayden; Councilmen Atkinson, Kovacs, Paulus; J. Jackson Eaton, III,
--------------------- Esquire; Ryan Christman; Sandra A. Pudliner; Vicky Roth

It should be noted for the record that Councilwoman Hayden attended the meeting via telephone conference as a result of a disability, which does not permit her attendance in person.

Opening Bids:

1. Bid No. 2007-1 – Sale of GMC/Gruman Step Van

Chairman Paulus advised all in attendance that no bids have been received with respect to this matter. The Township’s Fire Chief, Mr. Robin Yoder, was in attendance at the meeting and advised the Board that the truck had been advertised in the Pennsylvania Firemen’s Magazine for approximately one and one-half months. Additionally, the truck was advertised locally in accordance with the Township’s bidding procedures. There was a discussion regarding the matter. Chairman Paulus suggested that the truck again be advertised in the Pennsylvania Firemen’s Magazine and the price be lowered to $4,000 rather than the $5,000 previously sought. It was also suggested that no bid bond be requested. The Township Attorney also advised that he would research the matter to determine if the Township could sell the vehicle without bid requirements. The Township’s Fire Chief advised the Board that the next Fire Chief’s meeting is the third Tuesday in July and possibly something could be worked out at that time. In resolution of the matter, Council determined to await the Township Attorney’s research to determine how to further handle this matter.

Motion: --- I move we waive the reading of the Minutes of the April 18, 2007 Regular Council Meeting and accept same as presented.

Reports:

1. Sandra A. Pudliner
Township Manager

1.) The Township Manager advised the Board that the Hanover Township Zoning Hearing will be hearing Appeal No. 2007-2 on Thursday, June 28, 2007 at 7:00 P.M. Mrs. Pudliner indicated that the appeal relates to a business on Race Street, which has currently nonconforming structures on the property. She noted that the applicant proposes to construct a new structure as a reasonable and natural expansion of a nonconforming structure on the property. Council determined that the Township would take no position in this matter.

2. Ryan Christman

In the absence of the Township Engineer, Mr. Ryan Christman appeared before the Board and offered no report at this time.

3. J. Jackson Eaton, III, Esquire
Township Attorney

1.) The Township Attorney advised the Board that we have received a check from Airport Centers to cover the condemnation procedures. Attorney Eaton advised that he has gone ahead and secured the services of an appraiser. That process is underway. As soon as the appraisals are received, the Township can hold an executive session to discuss the amounts of the appraisals. After that, we can try to negotiate and if that fails then proceed with condemnation. Councilman Atkinson questioned the Township Attorney as to the time line involved in the process. Attorney Eaton noted that once the condemnation takes place the Township holds title and then it is a question of damages. With respect to the time line involved in the appraisals, negotiations, final response, etc., the Township Attorney estimated the process to be approximately three months. However, he did note that if they file preliminary objections, then the process could take longer.

Unfinished Business:

1.) Bill No. 2007-6, An Ordinance Amending Chapter 15, Part IV of the Statutory Code of Hanover Township to Restrict the Parking of Vehicles Without Current Registration or Current Inspection Certificates on Public Roads (Public Hearing).

Chairman Paulus opened the Public Hearing relative to Bill No. 2007-6. Councilman Atkinson commented that the purpose of this proposed Ordinance is to allow the Township to cover non-moving vehicles with no inspection or registration from parking on public streets since the state does not have provisions to cover same. There was discussion involving language in the proposed Ordinance which permitted a vehicle with a Pennsylvania Certificate of Inspection or Emissions Inspection which is expired or a vehicle displaying Vehicle Registration which is expired parking on the public street for more than two months before action could be taken. Council determined that two months was too long a period of time and amended the ordinance to make it 30 days. In resolution of this matter, the Board made the following motions:

Motion: --- I move that we amend Bill No. 2007-6 to reduce the waiting period after the expiration of Pennsylvania Vehicle Registration or Pennsylvania Certificate of Inspection or Emissions Inspection from two months to 30 days.

Motion: --- I move that Bill No. 2007-6, An Ordinance Amending Chapter 15, Part IV of the Statutory Code of Hanover Township to Restrict the Parking of Vehicles Without Current Registration or Current Inspection Certificates on Public Roads, be adopted as amended as Ordinance No. 474.

New Business:

1.) Resolution No. 2007-34, A Resolution Granting Preliminary/Final Land Development, B. Braun Medical Parking Lot Expansion, 901 Marcon Blvd., Allentown, PA 18109 (Vote).

Braun Medical. Attorney Charlesworth advised that the Hanover Township Planning Commission had made a recommendation for the granting of Preliminary/Final Plan Approval subject to conditions set forth in the Township Engineer’s letter to them. Attorney Charlesworth advised that the plan has been revised in accordance with the comments of the Township Engineer. He did advise the Board that this approval only relates to a parking lot expansion on the property and that there is a second phase regarding the building expansion, which will be going to the Hanover Township Planning Commission shortly. There was some discussion involving the conditions for approval. In particular, there was discussion regarding the fact that the existing Sure Fit driveway will be closed off and that a concrete island shall be shown at the Irving Street access with “No Left Turn”. Chairman Paulus questioned the Developer’s representatives as to whether or not the conditions for approval were acceptable and Attorney Charlesworth after reviewing same acknowledged that they were acceptable to his client. Councilman Atkinson questioned whether there were any fire hydrant issues and Mr. Bruce Anderson of the Pidcock Company, the Developer’s engineers, advised that everything is in accordance with what was discussed with the Township’s Fire Company. In resolution of the matter, the Board made the following motion:

Motion: --- I move that Resolution No. 2007-34, A Resolution Granting Preliminary/Final Land Development, B. Braun Medical Parking Lot Expansion, 901 Marcon Blvd., Allentown, PA 18109 be adopted as presented.
