I move we waive the reading of the Minutes of the March
2, 2005 Regular Council Meeting and accept same as presented.

Township Manager
The Township
Manager noted that the Board has received copies of information
relative to the PSATS Hall of Fame as same relates to an
article being done about Councilwoman Hayden in the Pennsylvania
Township News Publication. As you will note, PSATS anticipates
scheduling a piece in the magazine on Eleanore Hayden in
the June, 2005, issue. They have indicated they will be
contacting Mrs. Hayden regarding same.
Councilman
Atkinson questioned the signage along Willowbrook Road
for the residential development being constructed in Allen
Township known as Brookdale. The Township Manager advised
that the Code Enforcement Officers have been removing such
signage. It was noted that the contractor has an office
and in that regard the Township Manager advised that someone
would be in touch with them to advise that such signage
is not allowable in the Township.

Township Engineer
The Township
Engineer advised the Board that he had nothing to report
at this time.
Chairman
Paulus questioned the Township Engineer with respect to information
he read about regarding Bethlehem Township’s need to
acquire allocation from other townships for sewer. He questioned
the Township Engineer as to whether or not Hanover Township
had some extra allocation. The Township Engineer noted that
he believed the Township had 230,000 gallons per day allocation
in the Bethlehem Sewer Plant and is currently using approximately
130,000 gallons. He further noted that the Township will
have two more restaurants constructed in the Township. He
advised that, eventually, flow will go down Lloyd Street
when Pump Station 6 is taken off line. The Township’s
option would be to improve the situation at Pump Station
6 or have all the flow go by gravity all the way down. The
Township Engineer also indicated that it is common knowledge
that Bethlehem Township is hurting at the present time and
he further noted that the City of Bethlehem has not upgraded
their plant for a considerable time.
Councilman
Atkinson indicated that he has noticed that the construction
site in LVIPIII has finally put more stone down and is not
depositing mud on the street. The Township Engineer noted
that the Township Manager had written to them and that his
office had also been in touch with the contractor and that
the problem seems to have been remedied.

Township Attorney
1.) With
respect to the issue of condominiums treated under the subdivision
and land development and zoning ordinance, the Township Attorney
advised that his recommendation with respect to the approval
process for land development is that the Township will need
some different changes from land development when you have
one unit coming in for development for the whole development.
He noted that he would go ahead and prepare an ordinance
to address that issue and have the Township Engineer review
same.
2.) With
respect to changes in state law relating to fireworks, the
Township
Attorney advised the Board that he has prepared a proposed
ordinance for introduction at this time. He noted that the
ordinance lists those items, which were under our control
and are now under state control and changes some of the definitions
under state law. Attorney Eaton further noted that this is
all very technical and that he has also provided the Board
with a memorandum addressing the fireworks ordinance, which
can be reviewed in conjunction with the proposed ordinance.
The
Township Manager advised the Township Attorney that Code Enforcement
Officer John Lemos has indicated to her that the private road
behind the Red Roof Inn is in a very hazardous state with numerous
large potholes on the roadway. Mr. Lemos questioned the Township
Manager as to whether or not the Township has any liability
for accidents occurring in that area. The Township Attorney
felt
that he needed to look at the land development plan. There
was discussion of maintenance of driveways, etc.
Councilman
Atkinson brought to the Township Manager’s attention
that the Valley Plaza Shopping Center needs to repaint the
stop block and replace the pole and stop sign in front of the
Weis Market facility. The Township Manager advised she would
be in touch with the shopping center’s maintenance personnel
regarding same.

At
this point in the meeting,
Councilman Atkinson questioned
the Township Attorney regarding
the issue of condos as same
relates to the ability to control
the subdivision after the fact.
In particular, he questioned
the issue of not meeting subdivided
lot criteria. The Township
Attorney noted that he is still
pondering that issue. The Township
Attorney noted that there are
two types, one flex and the
one recently filed being nonflex.
He indicated he is still trying
to figure out if we can monitor
this in the future.

1. Bill
No. 2005-03, An Ordinance Amending Chapter 7, Part 4 (“Fireworks”),
of the Statutory Code of Hanover Township to Comply with
Act 2004-204 (S.B. No. 856) Regulating the Sale of Fireworks .
(Introduce).
Motion: ---
I move Council authorize payment of Voucher Nos. 10973 (Prepaids),
Voucher Nos. 10974-11023; Payroll dated 02/25/05, Payroll
dated 03/11/05, BC/BS (April), from the General Fund Account
in the amount of $71,700.20; Voucher Nos. 1536-1542 from
the Capital Reserve Account in the amount of $20,664.69;
Voucher Nos. 1247-1250 from the Escrow Account in the amount
of $1,885.75; Voucher Nos. 1519-1524 from the Water Account
in the amount of $339.57; Voucher Nos. 2498-2512 from the
Sewer Account in the amount of $22,613.68 for a Grand Total
Expenditure of $117,203.89.

Mr. Skip Keim,
1635 N. Halstead Street, questioned the Township Attorney relative
to the proposed ordinance dealing with fireworks. The Township
Attorney noted that previously the sale of fireworks was controlled
by the Township but that now same is controlled by the State
Department of Agriculture. Attorney Eaton noted that the state
will establish the type of permit and the type of facility in
which fireworks can be sold. He further advised that the Township
had an ordinance controlling the sale of fireworks. The Township,
however, cannot control same anymore. The Township can only control
their display and use. Finalizing the discussions the Township
Attorney indicated that the Township cannot control the sale
of fireworks in the Township due to the new state law. Councilman
Atkinson commented that the Township had restrictions in place
but that the new state law will take precedence.
Mr.
Keim questioned the discussion in the Minutes regarding the
termination of the manager of the Carmike Cinemas facility.
The Township Manager advised that the Township’s only
comments related to the fact that the manager who supposedly
had been terminated worked well with the Township and that
he was a more mature individual than previous managers at that
facility.
Mr.
Keim questioned the parking situation at the C.L. Checkers
facility on Airport Road. He noted that he had gone to the
facility and that individuals were parking in various areas
other than the parking lot due to the full parking lot. When
he entered the Checkers facility he was surprised that the
place was not full and that there were tables empty at that
time. A lengthy discussion ensued at this point regarding the
Township’s regulations in zoning regarding parking requirements.
It was noted that when the remodeling of C. L. Checkers took
place, the number of parking places was sufficient to accommodate
the zoning requirements for the number of seats in the facility.
Mr. Keim expressed his concern with respect to the parking
requirements of the Township.
