Township Meeting - Minutes

HANOVER TOWNSHIP, LEHIGH COUNTY
REGULAR COUNCIL MEETING

July 20, 2005
7:30 P.M.

Approval of Minutes: ------ July 6, 2005, Regular Council Meeting

Motion: --- I move we waive the reading of the Minutes of the July 6, 2005 Regular Council Meeting and accept same as presented.

Reports:

1. Sandra A. Pudliner
Township Manager

1. The Township Manager advised the Board that she has provided them with a copy of correspondence with respect to the Telerex Corporation located at 954 and 944 Marcon Blvd. As Council will note in reviewing said correspondence, they are requesting the Township’s assistance with respect to exploring the area for additional visuals for drivers to see walkers, i.e. walking cross walk, marks on the asphalt or additional signs in the road as in other areas of business across from the Lehigh Valley International Airport. They note in their correspondence that they lease parking space from property at 939 Marcon Blvd. and also lease parking spaces at 964 Marcon Blvd. It appears that they have had very close calls with traffic for employees attempting to cross the street. The Township Manager advised that in speaking with the Public Works Department it would be their recommendation that if a cross walk is installed that it be installed from driveway to driveway which would be at an angle. If you went curb to curb, the curb would have to be removed and depressed curb put in place for handicap access. Councilman Atkinson commented that this matter has been discussed with some members of the Board and it would be their recommendation that we give the owner authority for sandwich-type boards, which note Pedestrian Crossing. He indicated that type of signage is utilized in LVIP I on City Line Road. The Township staff could go and look at them for their information and reference. Chairman Paulus noted that the Township Manager should ask the Public Works Director to check and see if in the catalogs the Township has there is a vendor that sells that type of signage and then pass that on for the owner for their purchase.

2. Frederick W. Hay, P.E.
Township Engineer

1. The Township Engineer advised that with respect to the continuing issue of noise disturbance by U.S. Foodservice, he had an opportunity to perform a sound study at the property of a Township resident on Sherwood Street who had advised the Township of the problem and that he had done the study on this person’s back porch. The decibel reading was 58, which is six decibels above the allowable 52 decibels. Thereafter, correspondence was sent to U.S. Foodservice advising them of the Township’s study. A representative from U.S. Foodservice had called and left a message for me and I have subsequently returned the call but we have been unable to get together as of this time. The Township Engineer expressed his concern that he was not aware of how U.S. Foodservice could abate the problem. He noted that down at the intersection the noise bounces off the building and is coming across. Mr. Hay advised the Board that since he is not an acoustical engineer he does not know if there is a way to sound proof the building and you still have the problem of loading the vehicles. Vice Chairman Atkinson questioned whether or not the berm in place could be made higher and the Township Engineer indicated that he didn’t know if that was even feasible. With respect to fencing, which was raised as a possibility, the Township Engineer commented that they had planted the trees up on the bank. Chairman Paulus recollected that the berm is 16 feet high but that in certain areas it was not feasible to make it that high and it is 15 to 15-1/2 feet high. The Township Engineer did comment that in five years the pines on the berm will grow in and that he felt that a fence will not hold. Chairman Paulus commented that he felt they should be parking the vehicles on the other side away from the residential area. It was again noted in the discussions that the sound is additive. The Township Engineer finalized the discussions by indicating that it is just a constant drone.

3. J. Jackson Eaton, III, Esquire
Township Attorney

1.) The Township Attorney advised that he has prepared a draft with respect to the Disruptive Tenant Ordinance. He noted that the draft is really a revision of the Allentown Ordinance. Attorney Eaton advised that he intends to schedule a meeting with the Building Inspector and the Township Code Enforcement Office to see how this would fit in. Vice Chairman Atkinson felt that the Township Attorney should meet with the appropriate individuals and after that occurs then the Board could look at the ordinance. Chairman Paulus commented that he has already had a discussion with the Township’s Building Inspector and there are some issues.

2.) The Township Attorney advised that at the beginning of this year the Pennsylvania Municipalities Planning Code was amended to clarify what expenses a municipality was permitted to recover from developers. There was some question if Attorney Fees could be recovered even though we provide for that in our ordinance. Attorney Eaton indicated that his review has indicated that the state changes have not made our ordinance inconsistent with the new requirements. However, Attorney Eaton felt that the Township Ordinance should utilize the language of the state ordinance and that he will begin the process for a revision. The Township will continue to be allowed to collect all its expenses as in the past even with the new state requirements.

Chairman Paulus acknowledged receipt of a written Maintenance Report, written Fire Company Report, written Code Enforcement Officers’ Reports, and written Building Inspector’s Report and same were noted for the record.

An issue was raised with respect to the cutting of weeds in the swale adjacent to the MacIntosh Motor Inn. The Township Manager advised that the Lehigh Valley International Airport apparently has a contract with PennDOT to cut certain areas within the Township. The airport is aware that this swale is under the ownership of PennDOT and will be cutting it in the near future.

8. Treasurer's Report (Written)

Motion: --- I move we accept the computer printouts dated July 20, 2005, for the General Fund Account, Capital Reserve Account, Escrow Account, Liquid Fuels Account, Sewer Account and Water Account subject to audit.

Motion: --- I move Council authorize payment of Voucher Nos. 11194-11196 (06/30/05 EOM Prepaids), Voucher Nos. 11197-11201 (7/20/05 Prepaids); Voucher Nos. 11202-11262; Payroll dated 06/17/05, Payroll dated 07/01/05, Payroll dated 7/15/05 from the General Fund Account in the amount of $451,695.59; Voucher Nos. 1560-1562 6/30/05 EOM Prepaids), Voucher Nos. 1563-1567 from the Capital Reserve Account in the amount of $44,110.56; Voucher Nos. 1278-1300 (6/30/05 EOM Prepaids), Voucher Nos. 1301-1310 (7/20/05 Prepaids), Voucher Nos. 1311-1314 from the Escrow Account in the amount of $13,477.50; Voucher Nos. 1547-1554 from the Water Account in the amount of $26,448.80; Voucher Nos. 2551-2560 from the Sewer Account in the amount of $109,586.85 for a Grand Total Expenditure of $645,319.30.

Vice Chairman Atkinson noted that the bill list in large part represented a shifting of funds from the General Fund to the Township’s Capital Program items.
Courtesy of the Floor:

Mr. Thomas Keim, 1635 N. Halstead Street, indicated to the Board that he has seen the property on City Line Road, which has a very well outlined crosswalk and signs which say at the top that vehicles are required to stop for pedestrians at the crosswalk. Mr. Keim noted that he does not know if you can just buy the signs and put them up or if you also need the crosswalk in place. Vice Chairman Atkinson indicated that the Township will have to look into that matter.

Councilwoman Hayden advised that she has with her if any member of the Board is interested, a copy of the regulations with respect to the Chestnut Grove Homeowner’s Association. Mrs. Hayden noted that she has become aware that there may be some questions about those regulations and that is the reason why she is providing same at this time.
