Township Meeting - Minutes

HANOVER TOWNSHIP, LEHIGH COUNTY
REGULAR COUNCIL MEETING

August 4 , 2004
7:30 P.M.

Present: --------------- Coucilwoman Hayden; Councilmen Atkinson, Kovacs, Paulus, J. Jackson Eaton, III, Esquire;

Approval of Minutes: ---------- July 21, 2004 Regular Council Meeting

Motion: ------- I move we waive the reading of the Minutes of the July 21, 2004, Regular Council Meeting and accept same as presented.

Reports:

1. Sandra A. Pudliner
Township Manager

1. The Township Manager advised the Board that she has provided them with copies of correspondence with respect to the Township’s dismissal from lawsuits involving a Vicky Olsen and Robert Docherty.

2. The Township Manager advised the Board that she has provided them with a copy of correspondence from the Department of Community and Economic Development indicating that the Township’s $30,000 Grant monies for the restrooms at Canal Park have been approved and the check will be forwarded within six to eight weeks. Councilman Atkinson questioned whether or not there were any special conditions attached to the grant and the Township Manager noted that there were no special conditions. The State simply requires a final closeout report with a copy of the invoices for the work performed as well as the Township’s check issued to the contractor.

3. The Township Manager advised Council that as they will note in reviewing the correspondence provided to them, a letter has been sent to the Pocono Downs facility indicating the Township’s position with respect to their providing the necessary security for the special events which they hold at their facility. Mrs. Pudliner noted that she has had no response from the correspondence as of this time.

At this point in the meeting, there was a discussion initiated by Councilman Kovacs regarding the construction of the Dunkin Donuts facility at Valley Plaza Shopping Center. Councilman Kovacs questioned the Township Manager as to whether or not all the procedures for the construction were met and the Township Manager indicated that all required permits were secured.

2. Ryan Christman
Township Engineer

In the absence of the Township Engineer, Ryan Christman attended the meeting on behalf of Keystone Consulting Engineers.

1. Mr. Christman advised the Board that they have received the executed contracts for the 2004 Road Program. He noted that the Township will now sign same and get them back to the contractor and a preconstruction meeting would then be scheduled. Chairman Paulus questioned whether or not everything was all right with the bid proposal and Mr. Christman indicated that everything was in order.

Attorney's Report

The Township Attorney offered no report at this time.

New Business:

1. Resolution No. 2004-29, Amending the Fee Resolution of Hanover Township (Vote).

The Township Manager advised the Board that the Fee Resolution is being amended to provide language with respect to the Township’s practice regarding reservation of park pavilions as follows; under 30 people at a gathering would not be required to pay a fee other than a refundable security deposit. Additionally, a charge has been added for copying drawings upon request. At this point in the meeting, there was a discussion with respect to revising the Fee Resolution to increase the charges for the rental of Canal Park from $200 to $250. It was the consensus of the Board that same be done. In that regard, the Board made the following motion:

Motion: ------- I move to amend the proposed Resolution No. 2004-29, to increase the Canal Park pavilion rental fee to $250 and also to increase the refundable security deposit to $250.

Motion: ------- I move that Resolution No. 2004-29, Amending the Fee Resolution of Hanover Township be adopted as amended.

There was some discussion at this point in the meeting relative to the memorandum provided by the Township Solicitor regarding the park rental situation. It was noted that the Canal Park pavilion is not located on property deeded to the Township from Lehigh County and accordingly there was no problem with the rental charges.
