Township Meeting - Minutes

HANOVER TOWNSHIP, LEHIGH COUNTY
REGULAR COUNCIL MEETING

August 18 , 2004
7:30 P.M.

Chairman Paulus advised all in attendance that Mr. Yoder was presently responding to a fire call, but hoped to be available to speak to Council prior to the end of the meeting.

Mr. George Young, a Township resident on Weaversville Road, was present at the meeting and Chairman Paulus inquired of Mr. Young as to what has transpired since his last appearance before the Board. Chairman Paulus questioned Mr. Young as to whether or not the Township Engineer had been in contact with him and Mr. Young indicated he had not heard from the Township Engineer. Chairman Paulus reiterated the history of the matter and that it is the desire of Mr. Young to tie into sewer in an area where the connection would be in Hanover Township, Northampton, County, but Mr. Young would be a customer of Hanover Township, Lehigh County. Chairman Paulus noted that in his conversations with the Township Engineer it appeared that it was the Engineer’s opinion that possibly due to the grades involved, Mr. Young would have to pump the sewerage. Mr. Young countered with the fact that the sewer line is across the street from his home. Councilman Kovacs commented that the Township Manager will call the Engineer immediately upon his return from vacation on Monday and have him contact Mr. Young. Mr. Young noted that the engineer in the other Hanover Township in Northampton County indicated to him that the costs for a hookup and permits due and owing to Hanover Township, Northampton County, would be approximately $3,000. Councilman Atkinson noted that Weaversville Road is a state road and the state will determine if the road can be cut or if Mr. Young would have to tunnel underneath the roadway. Councilman Williams suggested that possibly a meeting between the engineers involved and Mr. Young would be appropriate, but Mr. Young indicated that the engineer in Hanover Township, Northampton County, seems to never be available. The Township Solicitor advised the Board that ultimately the Township Engineer can give you his opinion. He further noted that Mr. Young would have to get PennDOT to rule on how Weaversville Road would be crossed for the sewer connection. In addition, an agreement would have to be entered into between Hanover Township, Northampton County, and Hanover Township, Lehigh County. The Township Attorney further advised that the ultimate decision as to whether or not the sewer connection is feasible would be Mr. Young’s. In conclusion of these discussions, Mr. Young provided the Township Manager with his home phone number and the Township Manager was directed to have the Township Engineer contact Mr. Young upon his return to the office on Monday.

1. The Township Manager advised the Board that on Tuesday, August 17, 2004, at 2:00 P.M., the Chairman of the Board, the Township Engineer and the Township Manager attended a meeting at the City of Bethlehem to discuss the Fuller drainage swale problem. The Township Manager noted that the Township Engineer provided plans to include the original land development plan and the as-built drawings prepared by an engineering firm on behalf of Fuller and the plans were reviewed at the meeting. The Public Works Director for the city noted that he could understand from looking at the drawings that what is currently there is not what was approved as part of the original land development. The original land development had a much larger swale area and the as-built drawings show that by placing the volleyball court in the area where it is situated they have redirected the swale and created a much smaller channel for the water to drain. The Mayor noted that the city engineer was on vacation and was due back on Monday and that these issues would again be addressed with him in attempt to determine why he was of the opinion that the situation, which currently exists was acceptable. It was also noted by the Mayor that the city solicitor has acknowledged correspondence from Attorney William Malkames who represents the Saylor’s Mobile Home Park located in Hanover Township, Lehigh County which is one of the entities impacted by the improper drainage of the swale. Chairman Paulus made everyone aware of the fact that in addition to Saylor’s Mobile Home Park there is the church property located on the corner of Grove and Schoenersville Road; namely, the Christ Evangelical Luthern Church, as well as the townhouse development known as Chestnut Grove Towne Garden Development which are also parties affected by the improper drainage of this swale. Bethlehem was also advised that if nothing could be resolved representatives of these affected properties intended to go to the Bethlehem City Council meetings to discuss their issues. In any event, the Mayor indicated that the city engineer would be consulted and that they would get back to the Township as to their position in this matter.

Chairman Paulus acknowledged receipt of a written Maintenance Report, written Fire Company Report, written Code Enforcement Officers’ Reports and a written Building Inspector’s Report and same were noted for the record.

With respect to the Maintenance Report, questions arose relative to the sinkhole in the Canal Park property and the Township Manager advised that it was in the location where Councilman Atkinson thought it was and that it had been repaired. With respect to the sinkhole on Postal Rd., Councilwoman Hayden commented that the Public Works Director had indicated that they would be televising the lines in the roads to determine if there are any problems in that area. With respect to the Code Enforcement Officers’ reports, Councilman Kovacs commented that he believed he knew the names of the five individuals responsible for vandalism in Sherwood Park.

8. Treasurer's Report

Motion: ------- I move we accept the computer printouts dated August 18, 2004, for the General Fund Account, Capital Reserve Account, Escrow Account, Liquid Fuels Account, Sewer Account and Water Account subject to audit.

New Business:

Councilman Kovacs provided the Township Manager with information, which he had received at the Lehigh County Association of Township Officials’ Summer Convention relating to manhole covers. Councilman Atkinson commented that the ones the Township presently has are adjustable and these would create bumps. However, the Township Manager was directed to have the Public Works Director look at the materials.

Payment of the Bills:

Motion: --- I move Council authorize payment of Voucher Nos. 10523 (7/30/04 EOM Prepaids), Voucher Nos. 10524-10527 (8/18/04 Prepaids) Voucher Nos. 10528-10582, Payroll dated 7/30/04, Payroll dated 8/13/04, BC Wire Transfer (September), from the General Fund Account in the amount of $146,297.40; Voucher Nos.1480 (Prepaids), Voucher Nos. 1481-1494, from the Capital Reserve Account in the amount of $112,737.64; Voucher Nos. 1211-1213, from the Escrow Account in the amount of $5,190.00; Voucher Nos. 1458-1467 from the Water Account in the amount of $1,403.17; Voucher Nos. 2356-2367, from the Sewer Account in the amount of $9,238.94 for a Grand Total Expenditure of $274,867.15
