Township Meeting - Minutes

HANOVER TOWNSHIP, LEHIGH COUNTY
REGULAR COUNCIL MEETING

November 16, 2005
7:30 P.M.

Present: --------------- Councilwoman Hayden; Councilmen Atkinson, Dreisbach, Kovacs, Jackson Eaton, III, Esquire;

Courtesy of the Floor:

Mrs. Joan Nauroth of 2049 Troxell Street approached the Board and indicated that the four residents affected by the recent flooding on Troxell Street have engaged the services of a lawyer on their behalf. Mrs. Nauroth noted that the lawyer had indicated to them that he would wait to hear from the Township as to whether or not there is a case of negligence and that everything will proceed from there. Mrs. Nauroth indicated the attorney involved is Attorney Christopher Shipman practicing with Asteak Law Offices.

Approval of Minutes: ------ October 19, 2005 Regular Council Meeting

The Township Attorney advised that at a prior meeting, the October 19, 2005 Council Meeting Minutes were tabled in order that he had an opportunity to review same. In that regard, the Township Attorney requested that on Page 3, Line 8, that the language be deleted where it is stated “the Township Attorney said this was not the case”. Council had no problem with this amendment and in resolution of the matter, made the following motion:

Motion: --- I move we waive the reading of the Minutes of the October 19, 2005 Regular Council Meeting and accept same as amended.

Reports:

1. Sandra A. Pudliner
Township Manager

1. The Township Manager advised that a citation has been filed in the matter involving Central Plains, LLC (Valley Plaza Shopping Centers) for a violation of the Subdivision and Land Development Ordinance. Should the defendant plead not guilty, the Township Manager noted that a hearing would be scheduled and she would keep the Board advised of further developments in this matter.

2. The Township Manager advised that the Hanover Township Planning Commission met and reviewed the Preliminary Plan Submission of Airport Centers. In that regard, the Planning Commission made a motion recommending Preliminary Plan Approval of the Developer’s Plan.

The Township Engineer was not in attendance at the meeting and accordingly no report was offered at this time.

3. J. Jackson Eaton, III, Esquire
Township Attorney

The Township Attorney advised the Board that he had nothing to report on at this time.

7. Treasurer's Report (Written)

Motion: --- I move we accept the computer printouts dated November 16, 2005, for the General Fund Account, Capital Reserve Account, Escrow Account, Liquid Fuels Account, Sewer Account and Water Account subject to audit.

8. Building Inspector's Report (Written)

Vice Chairman Atkinson acknowledged receipt of a written Maintenance Report, written Fire Company Report, written Code Enforcement Officers’ Reports, and written Building Inspector’s Report and same were noted for the record.

With respect to the Maintenance Report, Council questioned whether the emergency vehicle preemption equipment installed at the signal light at Airport and Catasauqua Rds. had passed an inspection and the Township Manager advised that same had occurred. There was also discussion with respect to the walkway installed at the request of an LVIP III property owner. Additionally, the Township had provided the signage required under law for the walkway. Council entered into a discussion that with the upcoming snow although the property owners are pulling the signs regularly, in the wintertime they will need to take the bases out also and that the Township Manager should advise them accordingly. With respect to the Code Enforcement Officers’ Reports, Council questioned whether or not the parking tickets issued by the Code Enforcement Officers are tracked and the Township Manager advised that a tracking system is in place and that after a period of time citations are issued. There was also discussion with respect to one of the Code Enforcement Officers locating a refrigerator placed outside at the Allendale Apartment Complex. Said refrigerator had the doors on. The Township Manager advised that previously there had been a problem with that and Allendale had received correspondence from the Township and corrected the situation. After lengthy discussion, Council determined that possibly a citation should be issued against Allendale for the new violation. With respect to the Building Inspector’s Report, Council inquired as to one citation, which is currently outstanding and the Township Manager advised that the Building Inspector is waiting for a hearing to be scheduled regarding that matter.

Unfinished Business: NONE

New Business:

1. Resolution No. 2005-31, A Resolution Authorizing a Holiday Dinner for Recognition and Appreciation for Service Rendered (Vote).

Motion: --- I move that Resolution No. 2005-31 be adopted as presented.

At this point in the meeting, Councilman Dreisbach expressed his feelings with respect to the recent election. He thanked everyone that ran for office and everyone that came out. He expressed his appreciation to the Township residents for coming out and voting and noted that is why we have elections.

Payment of the Bills:

Motion: --- I move Council authorize payment of Voucher Nos. 11431-11435 (10/31/05 Prepaids), Voucher Nos. 11436-11438 (11/16/05 Prepaids); Voucher Nos. 11439-11487; Payroll dated 10/21/05, Payroll dated 11/04/05, from the General Fund Account in the amount of $83,857.17; Voucher Nos. 1596-1606 from the Capital Reserve Account in the amount of $7,654.36; Voucher Nos. 1383 (10/31/05 Prepaids), Voucher Nos. 1384 (11/16/05 Prepaids); Voucher Nos. 1385-1390 from the Escrow Account in the amount of $1,463.00; Voucher Nos. 1583 (11/16/05 Prepaids); Voucher Nos. 1584-1590 from the Water Account in the amount of $336.80; Voucher Nos. 2602 (11/16/05 Prepaids); Voucher Nos. 2603-2610 from the Sewer Account in the amount of $904.58 for a Grand Total Expenditure of $94,215.91.

Courtesy of the Floor:

Mr. Joseph Feskanin, 1680 N. Irving Street, appeared before the Board and advised Council that he had attended the Planning Commission Meeting involving the Airport Centers Development. The Township Attorney took this opportunity to advise Mr. Feskanin that for all intents and purposes preliminary plan approval is final plan approval and that the developer is entitled to final plan approval if all the conditions for approval on the preliminary plan are met. Attorney Eaton further stated that if the developer has met all the conditions that the Township does not get to raise other issues. However, Attorney Eaton did note that developers may be willing to consider other things. Finally, Attorney Eaton noted that any issues that anyone feels should be raised should be done at the preliminary plan stage. The Township Manager noted that in reviewing the conditions set forth for preliminary plan approval she was of the opinion that all the concerns of the residents are included in those conditions.
